My spouse lives in a different state?

You can file your divorce in the state you have Residency in, regardless of where your spouse is. And if you can't find your spouse, in many cases we can still help. Keep in mind that if you do know where your spouse is located, it is always good to have him "served" with the divorce forms just to prevent any future surprises on either behalf.

We both moved to a different State since we married?

You can file your divorce in the state you have Residency in, regardless of where you were originally married. The average residency requirement is 6 months to 1 year.

I can’t find my spouse?

You'll have to show the court that you at least tried to the best of your ability. The court may require you to run a newspaper ad in the county where the courthouse is to inform your spouse of the legal proceeding. The court may also require you to sign a statement attesting that you diligently looked for your spouse.

My spouse is in prison and I don’t know what to do?

No problem as long as your spouse signs the agreement to the divorce; otherwise you will need a lawyer. This applies to all forms of incarceration.

My spouse is in the United States Military?

Special paperwork may be required, but we can still help you as long as your spouse is in agreement to the divorce and one of you can file the divorce papers.

Whoever is on US soil will need to be the one to file the divorce and if you happen to be military personnel and the one filing the divorce, you will file in the state that you fulfill residency in. It is usually where you are at the moment with the armed forces.

My spouse is refusing to sign the divorce papers, what now?

Your spouse can refuse all they want in the United States. As long as you can show the court that your spouse received the divorce papers, the case will continue and in most cases we’ve found your spouse will eventually default on their end as to a resolution.

 One of us is not a U.S. citizen how does that work?

Yes, we can still help. In a scenario where a spouse is not from the US and/or in the US, the divorce is filed by the person who fulfills residency (citizenship not necessary) in the US. The other spouse will have to sign the divorce forms in agreement (unless of course they can't be found). Call us and we will explain this to you.

How long is the divorce process?

An uncontested divorce takes about 46-90 days without children and 180 days with children. Call the county court in your state to find out for sure.

What is the current divorce rate in America?
It is frequently reported that the divorce rate in America is 50%. This data is not accurately correct, however, it is reasonably close to actual percentages. The Americans for Divorce Reform estimates that probably, 40 or possibly even 50 percent of marriages will end in divorce if current trends continue which is actually a projection.
